1. Data controller

OMG Tecnología (hereinafter "the Company"), domiciled in Colombia, is responsible for the processing of personal data collected through this website and other communication channels.

2. Legal framework

This policy is governed by the following Colombian regulations:

  • Article 15, Colombian Constitution — Right to privacy and habeas data.
  • Law 1581 of 2012 — General personal data protection regime.
  • Decree 1377 of 2013 — Partial regulation of Law 1581 of 2012.
  • Decree 1074 of 2015 — Sole Regulatory Decree for the Commerce, Industry and Tourism Sector (Chapters 25 and 26).
  • Constitutional Court rulings — Case law on the right to habeas data.

3. Definitions

In accordance with Law 1581 of 2012:

  • Personal data: Any information linked or that may be associated with a specific or identifiable natural person.
  • Sensitive data: Data that affects the owner's privacy or whose misuse may lead to discrimination (racial or ethnic origin, political orientation, religious beliefs, health data, sexual life, biometric data).
  • Data subject: Natural person whose personal data is being processed.
  • Processing: Any operation on personal data: collection, storage, use, circulation or deletion.
  • Data controller: Natural or legal person that decides on the database and/or the processing of the data.
  • Data processor: Natural or legal person that processes data on behalf of the controller.
  • Authorization: Prior, express and informed consent of the data subject for the processing of their personal data.

4. Personal data we collect

Depending on the contact channel, we may collect:

  • Full name
  • Email address
  • Phone or mobile number
  • Company or organization name
  • Message or project description
  • IP address and browsing data (cookies, analytics)

We do not collect sensitive data unless strictly necessary and with the express authorization of the data subject.

5. Purposes of processing

Personal data will be used to:

  1. Respond to inquiries, quote requests and information requirements.
  2. Manage the contractual or pre-contractual relationship with clients and prospects.
  3. Send information about our services, news and content of interest (only with prior authorization).

6. Data subject rights (Habeas Data)

In accordance with Article 8 of Law 1581 of 2012, as a data subject you have the right to:

  • Access: View your personal data that has been processed.
  • Update: Request updates to your data when it is incomplete or inaccurate.
  • Rectify: Correct information that is inaccurate or outdated.
  • Delete: Request the deletion of your data when constitutional and legal principles, rights and guarantees are not being respected.
  • Revoke authorization: Revoke the consent given for the processing of your personal data.
  • File complaints: File complaints with the Superintendence of Industry and Commerce (SIC) for violations of Law 1581 of 2012.
  • Object: Object to the processing of your personal data when there is a legitimate and well-founded reason.

7. Procedure to exercise your rights

To exercise any of the aforementioned rights, the data subject may send a request to:

The request must include:

  • Full name and identification document of the data subject.
  • Clear description of the facts and the request.
  • Contact address and email to receive the response.
  • Supporting documents (when applicable).

Response times: Inquiries will be answered within a maximum of ten (10) business days from the date of receipt. Claims will be answered within a maximum of fifteen (15) business days. If it is not possible to respond within that period, the data subject will be informed of the reasons and the date of response, which in no case may exceed eight (8) additional business days.

8. Cookies and tracking technologies

This website uses:

  • Own analytics: We use a self-hosted analytics system to measure traffic and user behavior on the site. Data is processed on our own servers.
  • Technical cookies: Necessary for the operation of the site (language preferences, session).

Users can configure their browser to reject or delete cookies. However, this may affect website functionality.

9. Security measures

OMG Tecnología implements reasonable technical, human and administrative measures to protect personal data against unauthorized access, loss, alteration or disclosure. These include: encrypted communications (HTTPS/TLS), access control, and internal information management policies.

Personal data may be transmitted to data processors (technology service providers such as hosting, analytics or email) operating within or outside Colombia, always under contracts that guarantee adequate security conditions in accordance with Law 1581 of 2012. We do not sell or trade personal data to third parties.

11. Validity

This policy takes effect from the date of its publication on the website and will remain in force as long as OMG Tecnología processes personal data.

Personal data will be retained for as long as necessary to fulfill the purposes described in this policy, or while a legal or contractual obligation requires it. Once the purpose is fulfilled, the data will be deleted from our databases.

12. Changes to this policy

OMG Tecnología reserves the right to modify this policy at any time. Any changes will be published on this page with the corresponding update date. Continued use of the website after the publication of changes constitutes acceptance thereof.

13. Data protection authority

The authority responsible for overseeing compliance with data protection regulations in Colombia is the Superintendence of Industry and Commerce (SIC).
